Welcome to Elevated Movements. These Terms of Service ("Terms") govern your access to and use of the website at www.elevatedmovements.com (the "Site") and the services, content, and communications we provide (collectively, the "Services"), operated by Elevated Movements LLC ("Elevated Movements," "we," "us," or "our"). By accessing or using the Services, or by opting in to receive communications from us, you agree to be bound by these Terms. If you do not agree, please do not use the Services.

1. Use of the Services

You may use the Services only for lawful purposes and in accordance with these Terms. You agree not to misuse the Services, interfere with their operation, or attempt to access them by any method other than the interface and instructions we provide.

2. SMS / Text Messaging Program

If you opt in to our SMS program, the following terms apply:

  • Program description. We send operational and informational text messages — such as the daily SF Skate Club enrollment update — to recipients who have opted in.
  • Message frequency. Message frequency varies by program; for the enrollment update it is approximately one message per day.
  • Message and data rates. Message and data rates may apply.
  • Help and cancellation. Reply HELP for help or STOP to unsubscribe at any time. After you text STOP, you will receive one confirmation message and no further messages unless you opt in again.
  • Carriers. Carriers are not liable for delayed or undelivered messages.
  • Privacy. We do not share your mobile opt-in information or SMS consent with third parties or affiliates for their marketing purposes. See our Privacy Policy.

3. Intellectual Property

The Site and its content — including text, graphics, logos, and trademarks such as "Human Asset Depreciation™" — are owned by or licensed to Elevated Movements and protected by intellectual property laws. You may not copy, reproduce, or distribute our content without our prior written permission.

4. Third-Party Links and Services

The Services may contain links to third-party websites or services that we do not control. We are not responsible for the content, policies, or practices of any third party.

5. Disclaimers

The Services are provided "as is" and "as available," without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure.

To the fullest extent permitted by law, Elevated Movements and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, use, or goodwill, arising out of or relating to your use of the Services.

We may update these Terms from time to time. Changes are effective when posted on this page, and we will update the "Last updated" date above. Your continued use of the Services after changes are posted constitutes acceptance of the revised Terms.

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Any disputes will be resolved in the state or federal courts located in California.
